Sharing Terms

These Sharing Terms ("Terms") form an integral part of the Terms of Service of the Inkover service and apply to the use of the publication (sharing) feature for translated materials. Using the publication feature constitutes unconditional acceptance of these Terms.

1. Voluntary Nature of Publication

Publication of materials through the sharing feature occurs solely at the User's initiative. The Service never publishes User content automatically. By default, all processing results are private and accessible only to the User who uploaded the source material.

2. User Representations

By activating publication, the User represents that:

  1. Authority. The User holds all rights necessary to make the published translation available to the public, or has direct permission from the rights holder, or the use falls within a statutory copyright exception applicable in the relevant jurisdiction (for example, fair use under 17 U.S.C. § 107 for US users, the quotation exception under Article 5(3)(d) of Directive 2001/29/EC for EEA users, or Articles 1273–1275 of the Civil Code of the Russian Federation for Russian users).
  2. Derivative work status. The User understands that an automated manga translation is a derivative work for copyright purposes (for example, a "derivative work" under 17 U.S.C. § 101 and Article 1260 of the Russian Civil Code), and its lawful use requires the permission of the author of the original where such permission is required by applicable law.
  3. Age and prohibited content. The published materials do not contain any content prohibited by § 8 of the Terms of Service and comply with the content-protection rules applicable to the User's jurisdiction (for example, COPPA for US users, the UK Online Safety Act for UK users and Russian Federal Law No. 436-FZ for Russian users).
  4. Third-party rights. Publication does not infringe any third-party rights to image, personal data, business reputation or any other legally protected interest under the applicable law of the rights holder's jurisdiction.

3. Access Levels and Their Consequences

  • Private — materials are visible only to the owner. These Terms do not apply.
  • Link — materials are accessible to anyone who knows the URL, without authentication. Search-engine indexing is disabled (noindex, nofollow, robots.txt disallow); however, the User acknowledges that non-indexation by third parties cannot be guaranteed.
  • Authenticated — materials are accessible to any authenticated User of the Service.
  • Allowlist — materials are accessible only to Users whose email addresses the Owner has added to an allowlist. The allowlist and access-change events are logged.

4. Licence Granted by the User to the Operator

During the publication period, the User grants the Operator a non-exclusive, royalty-free, revocable licence to store, cache, transmit over communication networks and display the published materials to Visitors, solely for the purposes of operating the sharing feature. The scope of the licence is described in detail in § 6.2 of the Terms of Service.

5. Complaints and Counter-Notifications

Complaints from rights holders and third parties are accepted via the form at /shared/report and at [email protected]. The procedure and timelines are set out in the Copyright Policy and in § 10.5 of the Terms of Service. A User whose publication has been removed following a complaint may submit a counter-notification via the form at /shared/counter-notice within 14 business days of the measure.

6. Liability

The User bears full, independent liability for the lawfulness of publication and its consequences. Where third-party claims are brought against the Operator in relation to published materials, § 11 of the Terms of Service applies: the User undertakes to indemnify the Operator from such claims and to compensate any losses incurred.

7. Unpublication and Termination

The User may unpublish at any time through the settings of the relevant manga or chapter. Unpublication terminates the licence set out in § 4 of these Terms and results in the removal of public links. Only audit-log entries remain, retained in accordance with the retention periods set out in the Privacy Policy.

8. Governing Law

These Terms are governed by the laws of the Russian Federation, where the Operator is registered. Disputes are resolved in accordance with the procedure set out in § 14 of the Terms of Service. Consumer-protection mandatory rules of the User's country of habitual residence are preserved.
